A large class-action of regarding the functionality of Horizon – a large, bespoke electronic funds transfer at point of sale (EFTPOS) payment and accounting system, resulting in a £58m award to the claimants.

    Managed a team of experts appointed to provide ongoing expert determination and dispute management for an automotive distributor based in the Middle East and its South African SAP implementation partner. Completion of a US$100m+ SAP platform solution required continuous progress monitoring and reporting on delays due to resourcing and scope changes.

    Lead for the technology aspects of a $100m+ project delay dispute in the defence and aerospace sector. Worked with the delay team to determine the root causes of delays and the relevance of certain technologies and management practices.

  • Expert Advisory (Clinical Trial System)

    Advisor for warranty & indemnity matter relating to the implementation of a leading clinical trial healthcare system used in the pharmaceutical industry. Requirement was to analyse and assess the causation of delays in the rollout of the software application and determine what was reasonably possible at the time the warranty was given.

  • IT Expert Advisory (Charity Sector)

    Appointed as IT expert for a digital transformation of a system based on the Salesforce platform in the charity sector which was being adopted as part of a group-wide consolidation effort. Work required a functional audit of legacy and new world systems in order to determine whether the new world system was detrimental to the client’s ability to meet its annual delivery targets.

  • Software Copyrights

    Associate for a $multi-million dispute relating to software copyrights. Software was written in one programming language and then translated to another by an employee who moved from one company to a competitor. Issues included whether translated software still amounts to breach of copyrights, and whether a unique algorithm was the only logical method of programming this solution.

  • SAP Implementation Project Recovery for Large Media Corporation

    Associate instructed to provide technology advisory services for a US$60m dispute relating to the implementation of an SAP enterprise resource planning software system at a major UK media and broadcasting corporation.

  • IT Expert Witness for Maltese Arbitration

    Appointed as IT expert for a Maltese arbitration relating to a compliance and AML system. Work required a functional review of two software systems in order to determine whether the supplier of one breached the intellectual property rights of the other.

  • Healthcare Dispute

    Associate for the expert appointed for an IT dispute involving a claim against the UK Government in excess of US$1bn. The dispute centred on the failure of a US$3.75bn patient care records system. Issues requiring review included the quality of the software, the system design and project delivery to determine the root causes of delay which spanned many years.
